What is a Deceptive Trade Practice?
The Federal Trade Commission Act defines unfair or deceptive practice as conduct that offends public policy as established by statute, common law or other means; is immoral, unethical, troublesome or corrupt; and substantially injures consumers, competitors or other business people.
This federal law gives consumers the right to demand relief for even unintentional deception on the part of the seller. Some examples include the false advertising of food, drugs, devices, services or cosmetics; inaccurate pricing; deceptively marketing "free gifts;" distorting credit or payment terms; misleading representations regarding a product, including the type, content, origin, or tests and surveys about the product's effectiveness; or deceptive television commercials.
Similarly, the state has a law known as the Texas Deceptive Trade Practices-Consumer Protection Act. Texans may recover their economic and treble damages, attorneys' fees and costs incurred in a civil action against a business or person who knowingly violates the Act.

Contingency Fee Representation

If the business knowingly violated the Texas Deceptive Practices-Consumer Protection Act, we also seek to recover attorney fees.
Sylvan Lang is an experienced consumer protection lawyer who have represented both consumers and defendants in deceptive trade practice cases. We know how businesses defend these cases and we also know the defendant's weaknesses. Today our lawyers only represent consumers.
