What Is A Deceptive Trade Practice?

The Federal Trade Commission Act defines unfair or deceptive practice as a conduct that offends public policy as established by statute, common law or other means; is immoral, unethical, troublesome or corrupt; and substantially injures consumers, competitors or other business people.

This federal law gives consumers the right to demand relief for even unintentional deception on the part of the seller. Some examples include the false advertising of food, drugs, devices, services or cosmetics; inaccurate pricing; deceptively marketing “free gifts;” distorting credit or payment terms; misleading representations regarding a product, including the type, content, origin, or tests and surveys about the product’s effectiveness; or deceptive television commercials.

Similarly, the state has a law known as the Texas Deceptive Trade Practices-Consumer Protection Act. Texans may recover their economic and treble damages, attorneys’ fees and costs incurred in a civil action against a business or person who knowingly violates the Act.

Federal and state laws protect consumers from unfair and deceptive trade practices such as false advertising, the sale of shoddy or dangerous products, misrepresentations of the terms and conditions of a contract or warranty, and the failure to live up to the terms of a warranty or another contract.
