Helping You Combat Deceptive Trade Practices

The San Antonio consumer protection attorneys at Lang Law Firm P.C. represent individual consumers and businesses that are victims of deceptive trade practices in Central and South Texas. Sylvan Lang is an experienced consumer protection lawyer who has represented consumers and defendants in deceptive trade practice cases.

At our law firm, we know how businesses defend these cases, and we also know the defendant's weaknesses. Today our lawyers only represent consumers.

What Is A Deceptive Trade Practice?

The Federal Trade Commission Act defines unfair or deceptive practice as a conduct that offends public policy as established by statute, common law or other means; is immoral, unethical, troublesome or corrupt; and substantially injures consumers, competitors or other business people.

This federal law gives consumers the right to demand relief for even unintentional deception on the part of the seller. Some examples include the false advertising of food, drugs, devices, services or cosmetics; inaccurate pricing; deceptively marketing "free gifts;" distorting credit or payment terms; misleading representations regarding a product, including the type, content, origin, or tests and surveys about the product's effectiveness; or deceptive television commercials.

Similarly, the state has a law known as the Texas Deceptive Trade Practices-Consumer Protection Act. Texans may recover their economic and treble damages, attorneys' fees and costs incurred in a civil action against a business or person who knowingly violates the Act.

Federal and state laws protect consumers from unfair and deceptive trade practices such as false advertising, the sale of shoddy or dangerous products, misrepresentations of the terms and conditions of a contract or warranty, and the failure to live up to the terms of a warranty or another contract.

Contingency Fee Representation

Our lawyers handle many deceptive trade practice cases on a contingency fee system. Under this system, no attorney fees are charged unless we are successful in obtaining a recovery for you. If the business knowingly violated the Texas Deceptive Trade Practices-Consumer Protection Act, we also seek to recover attorney fees.
